welcome to amen adelaide. "we", "us", and "our" refer to amen adelaide. we run this website and store (the "services") using shopify.

these terms, along with our privacy policy and other policies we link to, set out your rights and responsibilities when you use our services. they include information about your rights under australian consumer law.

by using our services, you agree to these terms and our privacy policy. if you don't agree, please don't use the services.

1. access and account

you must be at least the age of majority in your state or territory, or have a parent or guardian's consent, to use our services.

you may be asked for details like your email, billing, payment, and shipping information. you confirm that this information is accurate and that you have the right to provide it.

you're responsible for keeping any account details secure, and for all activity on your account. you can't transfer or sell your account to someone else.

2. our products

we try to represent our products accurately, including colour, fit, and finish. actual products may vary slightly from photos due to screens, lighting, or natural fabric variation.

product details and availability can change at any time. we can discontinue a product or limit quantities at our discretion.

3. preorders and orders

many products are sold as preorders. this means we manufacture or ship the item after you order it, rather than from stock.

for preorders:

- the estimated timeframe is shown on the product page or your order confirmation, typically 4–6 weeks
- this is an estimate, not a guarantee, and may be longer due to delays
- we'll keep you updated if a delay happens
- placing an order is an offer to buy, not accepted until we confirm it
- full payment is required at checkout to secure a preorder

we can accept, decline, or cancel any order, for example if a product is mispriced, unavailable, or fraud is suspected. if we cancel your order, we'll try to contact you and refund you in full.

purchases are for personal use, not resale, unless we've agreed to a wholesale arrangement in writing.

4. prices and payment

prices are in aud and can change without notice. you'll pay the price shown when you place your order, as confirmed by email. prices exclude shipping unless stated.

payments are processed securely through shopify payments and other listed providers. by paying, you confirm you're authorised to use that payment method.

we can correct pricing errors, including after an order is placed, and cancel any affected order with a full refund.

5. shipping and delivery

we currently ship within australia only. delivery timeframes are estimates, not guarantees. we're not responsible for delays caused by carriers, weather, or other things outside our control.

once your order is with the carrier, risk passes to you, but this doesn't affect your rights under australian consumer law if the goods arrive faulty.

6. returns, refunds, and your consumer guarantees

returns and exchanges follow our returns policy.

nothing in these terms or our returns policy excludes your rights under australian consumer law (schedule 2 of the competition and consumer act 2010 (cth)). if a product fails to meet a consumer guarantee, you may be entitled to a repair, replacement, refund, or compensation, as set out by that law.

because many of our products are made to order, please choose your size and style carefully. this doesn't affect your statutory rights if a product is faulty, not fit for purpose, or significantly different from its description.

. intellectual property

everything on our services, including our name, logo, wordmark, designs, photography, and written content, belongs to amen adelaide or our licensors, and is protected by copyright and trade mark law.

you can use our services for personal, non-commercial use only. you can't copy, modify, distribute, or create derivative works from our content or branding without our written consent.

shopify's name and logo belong to shopify inc. other names, logos, and marks belong to their respective owners.

8. our charitable giving

we donate a portion of our profits to charitable causes, as described on our site from time to time. any statement about the amount donated or charity supported reflects our current practice, not a contractual term of your purchase, and may change over time. contact us for more detail.

9. optional third-party tools

we may give you access to tools from third parties, like payment processors or shipping providers, that we don't control. these are provided "as is," without warranty from us. use them at your own risk, and check their own terms.

10. third-party links

our services may link to third-party sites. we don't review or endorse this content and aren't responsible for it. any dealings with a third party are between you and them.

11. feedback and submissions

if you send us feedback, reviews, or ideas, you give us a free, worldwide licence to use and publish it, including for promotion, without paying you.

your feedback must not be unlawful, defamatory, obscene, or infringe someone else's rights. we can remove any submission at our discretion.

12. errors, inaccuracies and omissions

our services may contain errors in product details, pricing, or availability. we can correct these and update or cancel affected orders at any time, even after you've ordered.

13. prohibited uses

you agree not to use our services to:

- engage in unlawful, fraudulent, or malicious activity
- infringe our intellectual property or anyone else's
- harass, abuse, or discriminate against others
- send spam, malware, or harmful code
- scrape or use bots or ai agents to access the services without our consent
- bypass or interfere with our security

we can suspend or end your access if we believe you've breached these terms.

14. sms marketing policy

if you give us your mobile number and opt in to sms, you agree to receive texts from us, including order updates, cart reminders, and marketing. message frequency varies, and message or data rates may apply.

sms consent isn't required to make a purchase. reply stop to opt out, or reply help for support. you can also email amenadelaide1@gmail.com. we're not responsible for delivery delays caused by your carrier.

15. automated access and ai agents

if you use an automated agent to access our services, it must identify itself as automated, must not disguise itself as human or bypass security like captchas, and must follow these terms. we can block automated access.

16. termination

we can suspend or end your access at any time, including for breaching these terms. you remain responsible for anything owed up to that point.

sections that should survive termination, like intellectual property, feedback, disclaimers, and liability, continue to apply.

17. disclaimers

our services are provided "as is," to the extent permitted by law. we don't guarantee they'll be uninterrupted, error-free, or secure.

this doesn't affect any guarantee or right that can't be excluded under australian consumer law. where the law allows us to limit liability for a term that can't be excluded, our liability is limited to repairing, replacing, or resupplying the goods, or the cost of doing so.

18. limitation of liability

to the extent permitted by law, amen adelaide and our staff aren't liable for indirect or consequential loss from your use of our services or products.

this doesn't limit any liability that can't lawfully be limited, including for death or injury caused by negligence, or liability under australian consumer law.

19. indemnity

to the extent permitted by law, you agree to cover us for any loss, damage, or claim, including reasonable legal costs, arising from your breach of these terms, misuse of our services, or breach of any law or third-party right.

20. severability

if any part of these terms is found invalid, that part is removed, and the rest continues to apply.

 

21. dispute resolution

if a dispute comes up, please contact us first at amenadelaide1@gmail.com so we can try to resolve it directly. you can also make a complaint to an australian consumer body, like your state's fair trading office or the accc, or pursue any remedy available under australian law.

 

22. entire agreement

these terms, along with any linked policies, make up the entire agreement between you and amen adelaide, and replace any earlier agreements.

 

23. assignment

you can't transfer your rights or obligations under these terms without our consent. we can transfer these terms, including as part of a sale or restructure of our business.

 

24. governing law

these terms are governed by the laws of south australia. you and amen adelaide submit to the non-exclusive jurisdiction of south australian courts.

 

25. changes to these terms

we may update these terms by posting changes on our site. using our services after changes take effect means you accept the updated terms. check this page from time to time.
